Law and Ethics, Patients Rights in Practice Essay In particular, those aspects observed by the student relating to patients privacy, confidentiality and any situations which warranted a limitation to patient privacy will be described and discussed with reference to patients rights. Situations in the hospital setting where the student nurse viewed health professionals informing patients about treatment options, encouraging patients to take action in decisions about their health, and gaining informed, voluntary consent prior to procedures will be discussed. An explanation of reasons for selecting privacy and consent as two essential concepts which health providers must understand will be illustrated. The legal and ethical responsibility of health care providers in relation to the aforementioned fundamental principles of achieving patient privacy and gaining informed voluntary consent will be examined with a clear emphasis on patient’ rights. While on clinical placement, the student nurse observed health professionals maintaining patient privacy to a high standard by consistently shutting curtains around patient’s beds, lowering their voices when working with patients in rooms containing multiple beds, courteously requesting visitors to leave the room when procedures of a sensitive nature were preformed and closing patient’s doors to limit unwanted interference from hallways. In order to show patients respect, dignity and consideration, which are outlined as a fundamental patient right in the Queensland Health Public Patient’s Charter (2002), patients were consistently examined in areas that were as private as was possible at the time. This attempt by health care providers to maintain the physical privacy of all patients by consistently minimizing unwarranted outside attention is a clear demonstration of how health care providers maintained patient dignity, consideration and respect. According to the Ramsay Health Care/Cairns Private Hospital Patient Charter (nd. , patients have a right to be treated with courtesy throughout their hospital experience. The actions of the health care team correlate positively to this statement as through the maintenance of patient’s physical privacy, health care providers are demonstrating consideration for their patients and respecting their rights set forth in both the Queensland Health public patient charte r and the Ramsay health care charter. Throughout the clinical placement of the student nurse, the health care facility in question demonstrated exceptional adherence to national privacy principles 4. set forth in the Privacy Amendment Act (2000). Initiatives currently in place at Cairns Private Hospital ensure confidentiality of both patient’s medical records as well as patient’s personal details by limiting outside access to confidential information and preventing health care professionals from transmitting such information to the broader community. One such example observed by the student nurse involves the hospitals policy preventing nurses from leaving the hospital with materials used in nursing handovers that contain information regarding patient’s condition and personal details. The destruction of such material prevents the transmission of private information to the wider community and demonstrates the role of health care providers in maintaining patient privacy. According to the national privacy principle 4. 1 extracted from the Privacy Amendment (Private Sector) Act (2000, p. 9), â€Å"An organisation must take reasonable steps to protect the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure. Therefore, by ensuring patients information is protected from unauthorised access and disclosure, Cairns Private Hospital is fulfilling the legal obligations set forth for private organizations in the Privacy Amendment Act (2000) principle 4. 1. Patient’s right to have their personal information kept private and confidential, as outlined in the Queensland Health Public Patient’s Charter (2002), was also exceptionally demonstrated by those nurses with whom the student nurse was in contact during c linical placement. Health care providers consistently maintained patient confidentiality by limiting discussion of patient’s condition to those situations where health care providers must share patient information to improve patient care. When the student nurse observed an exchange of information between health care providers pertaining to patient’s condition, it occurred in a manner such that other patients or visitors were unable to discern the content of discussion. This includes, but is not limited to, patient information related in nursing handovers. By treating patient’s personal information obtained in a professional capacity as confidential, nurses are adhering to the expected national standards for Australian nurses as stated in ANC Code of Professional Conduct for Nurses in Australia (nd. ). The importance of maintaining patient privacy is unquestionable. Patients belief that health care professionals will handle their personal information with respect, dignity and maintain their confidentiality not only illustrates the ethical and legal responsibilities of health care providers, but correlates positively with the formation of trust between patient and nurse. According to Stein-Parbury (2005 p. 42), â€Å"†¦ without trust, there is minimal self-disclosure and little chance that patients will share their experiences with nurses or that nurses will come to understand patients’ experiences. † Therefore, through the maintenance of patient privacy and confidentiality, the element of trust, which forms the basis of all nurse-patient relationships, is strengthened. Crisp and Taylor (2005), illustrated the importance of patient privacy and confidentiality as without these two essential components patients would not feel able to tell health care professionals their most intimate and private details. This potential hesitation to share personal information with health providers can have a negative impact on the provision of care and can ultimately lead to treatment that does not take into consideration essential aspects of patient’s health. The maintenance of patient’s privacy is essential in both building trust between nurse and patient and providing holistic nursing care. As stated previously, the maintenance of patient privacy has implications in both legal and ethical spheres and is paramount to the formation of the nurse-patient relationship. Student nurses must therefore gain an understanding of the importance of maintaining patient privacy to ensure that once qualified as a registered nurse, one will understand the reasons why legally and ethically we must adhere to the guidelines. In today’s health care setting, the emphasis of patient’s rights and understanding these rights is paramount if one wishes to practice safe appropriate care for all peoples. It is for these reasons that the central issue of patient privacy was selected for consideration. Although the importance of maintaining patient privacy is unquestionable, there are ertain situations that warrant the sharing of patient information. As observed by the student nurse, health care professionals continuously share patient information between themselves in attempts to allow allied health professionals to provide appropriate holistic patient care. In today’s hospitals, with shift work and the increasing specialization of various allied healt h workers, it is essential that patient information is shared to improve patients care and outcome. In order to achieve appropriate care for patient’s, this is a requirement and will not be considered as a breach of patient privacy. This team work approach to health care is viewed as of benefit to the patient and is absolutely essential is today’s health care facilities where health care professionals are increasingly working in more specialized fields. Throughout the entire clinical placement, the student nurse consistently observed health providers informing patients of their various treatment options, encouraging patients to take an active role in decisions about their health, and ultimately gaining informed voluntary consent prior to any procedure. As outlined in the Queensland Health Public Patients Charter (2002), and the Ramsay Health Care/Cairns Private Hospital Patient Charter (nd. ), patients have a right to easy to understand information about their condition, treatment options, risks, and expected outcomes. The health providers viewed by the student nurse exemplified exceptional adherence to the patients right to accurate information as nurses were observed directly informing patients wherever possible about their treatment options, risks, and choices available to them. Health care providers not only adhered to their legal obligation of providing treatment information to patients, but did so in a way that reflected nurses ability to use due care in support of their ethical responsibilities. According to the Ramsay Health Care/Cairns Private Hospital Patient Charter (nd. ), patients have a right to ask questions and seek clarification in regards to matters that concern them. The actions of the health care team exemplified good practice with reference to this patient right. Health care providers were willing at all times to respond to patients questions or concerns and faced each situation with enthusiasm and clear respect for patients right to ask questions and seek clarification. Patients right to take part in decisions about their health care as stated in the Queensland Public Health Charter ( 2002), was viewed by the student nurse to occur in conjunction with the aforementioned patient right to information about treatment. By providing patients with easy to understand information about their condition, it allowed patients to make informed choices regarding their treatment and overall health. Health professionals were observed to provide patients with the information they require such that patients could make their own decisions regarding their treatment options. By thoroughly providing patients with necessary information as well as encouraging patients to take an active role in decisions about their health, health providers were empowering patients and fostering patient’s autonomy. Autonomy, the freedom to decide and act (Stein-Parbury, 2005), can be enhanced when a patient is given information about their condition and encouraged to take an active role in making decisions about their health. Informing patients of various treatment options and encouraging patients to take an active role in decisions about their health are fundamental components of informed voluntary consent. Informed voluntary consent may be implied, written or verbally given. The student nurse observed various nurses obtaining implied consent from patients when performing routine procedures such as taking a blood pressure reading. The student also viewed health providers obtaining verbal consent from patients when preforming procedures such as showering and mobilizing patients. The health providers adhered to the legal requirements which state that consent must be voluntarily given and informed (Forrester Griffiths, 2005). The actions of the health care team correlate positively to the statements set forth in both the Queensland Health Public Patients Charter (2002) and the ANMC Code of Ethics for Nurses in Australia (nd. ). The charter asserts that patients have the right to give their permission before they are treated. Whether consent was implied or verbal, the student nurse observed patients giving their permission prior to any procedure. According to Value Statement 2 in the Code of Nursing Ethics (nd. ), nurses must accept the rights of individuals to make informed choices in relation to their care. By ensuring that patients right to make informed choices in relation to their care and obtaining informed voluntary consent, health providers are meeting their legal and ethical obligations surrounding patients consent. It is essential that student nurses have an understanding of their moral and legal requirements surrounding patients consent. If a health provider performs a procedure without acquiring consent, there is a possibility that their actions legally may amount to assault or battery. According to Forrester and Griffiths (2005), battery involves the unlawful touching of a person without his or her consent. In charges of battery, there is no requirement that the patient sustains any injuries as a result of health professionals unlawful touching. Health providers must therefore have an understanding of the legal ramifications surrounding consent to ensure that they provide safe nursing care based on respecting patient’s legal rights. It is for this reason that the issue of patient’s consent was included for discussion in this paper. It is becoming increasingly important for health professionals to have an understanding of their legal and ethical responsibility for the maintenance of patient privacy and obtaining informed voluntary consent prior to preforming any procedure with patients. With the emphasis on patiens rights becoming more prevalent in the health care setting, it is essential that health care workers respect patient’s rights which include, but are not limited to, maintaining patient privacy and obtaining informed voluntary consent. The health providers present at the health care facility attended by the student nurse were observed to demonstrate good practice with respect to patients’ rights as set forth in the Queensland Health Public Patients Charter (2002).

John Savage Desires What Makes Essay -- essays research papers

Brave New World illustrates a world where everything that is morally right in our society, is wrong. Monogamy is sinful, massive orgies are not. Serious thinking is unnecessary because life has already been planned out. Hardships and stress can be solved with a few tablets of soma. This is the world which John Savage and others in the novel foolishly came to hate. All of the things that John Savage desires are the things that make our society unstable. Huxley uses John Savage to show the reader that this world is distopian, when this society is the closest example to a stable, utopian society.   Ã‚  Ã‚  Ã‚  Ã‚  Uninhibited sexual freedom provides happiness to this society’s citizens, the Fordians. Promiscuity is encouraged, and monogamy is discouraged. There is no room for love, or real emotional ties. John Savage does not agree with these ideas, but he fails to see the implications of loving others. In our society, love and sexual desire are the causes of murder, suicide, and rape. â€Å"Everyone belongs to everyone else†(pg.35). This is one of the many hypnopaedic messages that are repeated to the Fordians. It prevents them from feeling passion, desire, lust, jealousy, and true love. In absence of these feelings, they are free from emotional ties and have no reason to rape or murder someone because of inner desires. They are able to express their sexuality with others, and release sexual tension. Hurt and pain is eliminated from their minds, and these people can live the rest of their lives with child-like bliss. John Savage disagrees with these ideas and objects by stating, â€Å"The murkiest den, the most opportune place† (the voice or conscience thundered poetically), â€Å"the strongest suggestion our worser genius can, shall never melt mine honour into lust. Never, never!† (pg. 174-175) This occurs when Lenina wanted to have sex with John. Instead of accepting her invitation, he lashes out at her screaming, â€Å"Whore! Impudent strumpet!† (pg. 176). Meaning that he fails to understand how the Fordian society works. Not only that, but the fact that there are many in our society who can only wish to be in his place.   Ã‚  Ã‚  Ã‚  Ã‚  Another form of happiness that Huxley supplies to the Fordians is soma. The hypnopaedic message â€Å"†¦a gramme is better than a damn,†(pg.49) is repeated to these individuals so that they take soma instead of worrying... ...ot independent ideas of their own. Everyone, in a word, who’s anyone.† (pg.207) Even ‘free thinkers’ are able to live peacefully in the Fordian society. They have the choice to retreat to an island where there are many people who may share the same views. The Fordian society is not communistic. They do not execute those who think for themselves, but allow them to grow. Even though they may not have the ability to spread their knowledge on to others, their needs are fulfilled.   Ã‚  Ã‚  Ã‚  Ã‚  Is the Fordian society utopian? It is impossible to say no when there is less conflict, no pain, happiness, no jealousy, harmony, efficiency, stability, and no disease. John Savage entered the Fordian world, not the other way around. If he wanted to be singled out, beaten, and hated, then he could have stayed in the reservation. The Fordian society was prepared to embrace him, but he was not willing to adapt. Due to his stubborn nature he eventually committed suicide. John was offered a unique opportunity to live along with the Fordians, but his inability to change himself led to his death. If any other savage were given such an opportunity, they would have take in immediately.

Erasmus, Praise of Folly Essay

1.) In Joe Sachs translation of, Aristotle’s on the soul and on Memory and Recollection, we are presented with the idea that our soul is broken up in to the contemplative and the practical forms of intellect. We use our contemplative and practical intellect to identify what is good for us, so that our desires reflect our needs. Although, they both work towards the same goal, both are separate and depend on ineffable forces for success. The contemplative intellect is fueled by our curiosity for knowledge. Aristotle was a major believer in contemplation because he believed that living a contemplative life is how humans should live. A contemplative life allows humans to lead a morally sound life. The more humans engage in contemplation, the closer they are to their gods and the happier they will be. The contemplative intellect is our capacity to determine the potentiality of the practical intellect. The practical intellect is our response to our contemplation. Contemplation can prolong political disasters and prevent us from using practicality. But, we have no choice but to contemplate because to understand we must contemplate and to act morally we must be able to understand. Being able to understand is being able to grasp the potentiality of something. Misunderstanding something’s potentiality is the reason leading a practical life is more difficult. It is human nature to contemplate. Distinguishing the two intellects is tricky because Aristotle stresses that we are one soul part of a larger one. However, if it is the same soul producing practical and contemplative intellect, how can life be divided into these two things? Our individuality controls our actions. So, our contemplative is what makes us what we are and our existence is the reason we act (practical). Practicality and contemplation are distinctions within our intellect. Contemplation is to be looked at as human nature, it helps us understand. Understanding gives way to the practical intellect. These two separate intellects not only involve different unknown forces, but they also utilize different types of motion. Practical is a physical motion, while contemplation is a motion in the sense that whenever we are thinking and contemplating, we/our minds are in motion. The soul seeks truth. Contemplation leads us towards the truth, while practicality is a truth. These intellects are virtues in different parts of the soul. To acquire happiness one must have moral virtue to choose correctly and practicality to choose ‘how.’ For example, one might attain the knowledge, facts, and actuality of how to ride a bike. But, knowing those facts does not determine your potential to ride the bike. Aristotle provides an affective example, â€Å"There is something that has knowledge in the way that we say any human being is a knower, because humanity is part of the class of what knows and has knowledge, but there is also a sense in which we mean by a knower the one who already has, say, grammatical skill; and each of these is in potency but not in the same way, but the former is because his kind and his material are of a certain sort, while the latter is because he is capable of contemplating when he wants to, if nothing outside him prevents it† (417a 23-30 Aristotle). Aristotle tells us the there are different types of potentiality and actuality here. This example demonstrates a ‘knower.’ A knower would be human, know grammar, and talking (exercising knowledge). This example is important in the distinction because it describes the process and the different roles of contemplation and practicality. The contemplative intellect, in this case, would be that the knower is human and has potential without actual knowledge. The knower, with grammatical knowledge, has this knowledge but is not thinking about it. The knower would be exercising knowledge through recognizing grammatical errors in conversation, readings, etc. In the two most previous instances the knower uses their practicality intellect because their actual knowledge of the grammar is their potentiality to think and perform actions. Contemplation allows us to do, think, and imagine anything we want within out minds/soul. â€Å"†¦The soul is a being-at-work-staying-itself in the way that knowledge is, for both sleep and waking are in what belongs to the soul, and waking is analogous to the act of contemplating but sleep to holding the capacity for contemplating while not putting it to work (practical).† (412b 26-30 Aristotle). Practicality can only utilize what is physical and in front of us. Aristotle The connection between these intellects demonstrates Aristotle’s belief that every body contains a soul and the soul is not separate matter. It is a capacity, it doesn’t have a capacity and is inseparable from the body. The soul has no identity. Aristotle believes we are all individual human beings, made up of different forms and matter. But, there is one soul that is in all of us, equally. No one persons soul is ‘better’ than another’s. This is important in the distinction because contemplation takes place in the soul and practicality is what we do with the connection between our soul and body. 2. ) In Erasmus’, Praise of Folly, the character Folly is used to express Erasmus’ philosophy. Folly states that the actions of different people are foolish and she is congratulating them, she calls wisdom foolish and the fools, wise. Throughout the book Folly, with sarcasm and satire, demonstrates the main forms of folly in order to show the importance of folly. Erasmus wanted to share three main forms of folly in his writing. The first form being, the fundamental form of folly, which is the force in our life that is indescribable. This form mainly refers to religion and faith, but also the folly in any belief of a higher/greater good. The second form is the human folly. In this form, Folly mocked those who deem or consider themselves wise or philosophers. She picked on mainly prominent people, anyone who thought they were better because they knew more about something. The third form is best described by egotistical, hypocritical, and greedy folly. This form depicts the folly of the self-centeredness of humans. Erasmus as Folly illustrates how the Christians appear foolish at first, yet actually possesses true wisdom. Folly quotes the Bible repeatedly to prove her point. She uses the passages to show how folly is good. Within these passages, Folly says that the bible, values fools more than the wise. For example, Adam and Everwere forbidden to eat from the Tree of Knowledge, but they disobeyed. Thus, knowledge destroyed their happiness. Folly describes the Christian fools as those who, â€Å"squander their possessions, ignore insults, submit to being cheated, make no distinction between friends and enemies, shun pleasure, sustain themselves on fasting, vigils, tears, toil, the humiliations, scorn life, and desire only death – in short, they seem to be dead to any normal feelings, as if their spirit dwelt elsewhere than in their body† (p. 128 Erasmus). Folly deems Christians slightly mad because of their view on life, and how they are so focused on the spiritual and eternal that they barely live. Erasmus contradicts Biblical truths when he is speaking as folly and expresses that life would be meaningless without folly. Our world, especially in the United States, relies on instant gratification, but the Bible clearly teaches that those kinds of things will pass away and are not important. Erasmus challenges Biblical truths when he praises ignorance, self-loveand flattery. This goes directly against the Bible, which speaks out against these kinds of things. He explains that the piousness of Christians is madness. In the second form, Folly takes the prominent professions of her time and shows their folly. She begins with merchants, who she describes as liars and thief’s yet they are still respectable citizens. Next she attacks a grammarian, â€Å"He supposes he’d be perfectly happy if he were allowed to live long enough to define precisely how the eight parts of speech should be distinguished, something in which no one writing in Greek or Latin has ever managed to be entirely successful. And then if anyone treats a conjunction as a word with the force of an adverb, it’s a thing to go to war about† (p. 80 Erasmus). Folly describes the schools as dirty and a waste of time. He believes the teachers teach useless information, but still feel important. He goes on to poets and rhetoricians and deems their professions purposeless. The narrator’s particular target is the church, â€Å"as they roll their rock of Sisyphus and string together six hundred laws in the same breath, no matter whether relevant or not†¦.However, their self-love keeps them happy, and three syllogisms arm them enough to go straight to battle on any subject and with any man† (p. 84 Erasmus). These foolish men explain the ‘mysteries’ of life and the Bible according to themselves. Even the monks exude folly. They take vows of poverty and claim to hate money, but still take part in other vices. This form of folly reminds us to not mask ourselves to make us look better. Just because a merchant is respectable profession, doesn’t make that specific merchant respectable. If a monk gives up his money, does that mean he has no other vices? â€Å"†¦why shouldn’t I rightly be recognized and named the ‘Alpha’ of all gods, when I dispense every benefit to all alike?† (p. 19 Erasmus). Folly allows life to continue because men must become silly fools to do it. Without her, she exclaims, couples would be married, and women would not repeat childbirth. Without the pleasure Folly gives to life, it would not be worth living. Folly accuses the stoics of attempting to keep all the pleasure for themselves while commanding others to avoid it. As an example, Folly uses childhood and old age. Everyone loves children because they are foolish and innocent. Age and life experiences only fade their beauty and charm. Thus, in old age Folly recognizes a second childhood, freeing us from the worries of life. With old age comes foolishness and senility, which allows them to be happy. These silly old people are much more fun to be around, then a wise old person. â€Å"’Folly is the one thing which can halt fleeting youth and ward off the relentless advance of old age’† (p. 25. Erasmus). Folly discovers that we use passion over reason, â€Å"he (Jupiter) confined reason to a cramped corner of the head and left all the rest of the body to the passions. Then he set up two raging tyrants in opposition to reason’s solitary power: anger, which holds sway in the breast and so controls the heart†¦Ã¢â‚¬  (p. 30 Erasmus). Folly is logical, when our human nature puts passion over reason. Folly concludes her praise of folly with a comparison to Plato’s, Allegory of the Cave. A man who lived in a cave by firelight his whole life, one day saw sunlight. But, the two men that remained in the cave, who would seem foolish, are equally as happy with what they believe is real. 3.) Aristotle makes a better case for his outlook on human life. It is important for humans to feel important and feel like they belong and have a purpose. Aristotle’s idea of the one soul, not only offers a sense of unity to the human race but also deepens the mystery of our existence. It is in contemplation that we find happiness, whether we contemplate our future, our past, or the present. Human happiness is rooted in human interaction and contemplation allows us to create commonality and it develops culture. Although the truth of folly is important in understanding human incentives, it is in our intellect that we can find harmony. Folly in itself is a folly. It pokes fun at the ignorance of human lives. Being foolish is innate in our nature. When do people have the best times? When they laugh and feel enjoyment from company. Our folly makes us human, it is necessary for our happiness. Erasmus presents folly as a much more bleak and pessimistic attribute. When Aristotle describes the soul it is much more pleasing. He stresses that sources/forces like God, are ineffable. These higher powers cannot be identified or described, but to believe in it reassures us that we are meant to be here. Without this mysterious force, who are we? Why are we here? It is our nature to feel wanted and have a purpose. We attempt to find this purpose through contemplation. This is a major aspect of human life. It forces us to look deeper and attempt to act morally. Humans are at their highest potential when they contemplate. Contemplation is a completely isolated process and helps us understand and perceive the world. This ability drives us and helps us advance. In personal experience, I find it is important to really think, ponder, and contemplate the things that make me happy. I can then decide if that is a practical thing to do or if I need to change what makes me happy. For example, drugs may make someone happy in their contemplation, but is that really what they want? Erasmus and Aristotle have contrasting outlooks on life. Erasmus is very realistic, sarcastic, and satirical. While Aristotle reaffirms that it is all right to contemplate the unknown. Aristotle brings us to higher level of thinking and helps us strive for a happier and morally active life.

In the early months of 2005, Terri Schiavo’s life story, involving her persistent vegetative state (PVS) captured the worldwide spotlight and brought up controversial issues surrounding guardian care of the patient, as well as the overall decisions made by Congress. The government involvement in her case impeded any decisions the family and spouse could properly address for the well being of Schiavo (Montero 166). The governmental court system in Terri Schiavo’s case behaved immorally in regard to the eventual removal of her feeding tube. In 1990, Schiavo suddenly collapsed in her house at the age of 26. Oxygen was depleted to her brain for several minutes as she lay unconscious on the ground. The cause of her collapse sent both her doctors and nurses into disarray because there was not a specific pinpoint reason for her collapse. Her husband, Michael Schiavo, suspected the collapse was due to a cardiac arrest from a potassium imbalance due to her suspected bulimia. H er parents, Bob and Mary Schindler, believed her fall was rendered by strangulation from Michael Schiavo, which caused the depletion of oxygen to her brain. Once admitted into the hospital, further examinations concurred that she did not suffer any heart or strangulation injuries.
